On 23 May 1997, the Court of Appeal of Bavaria (Bayreisches Oberstes Landesgericht) found Novislav Djajic guilty of having been an accessory to fourteen cases of murder in the former Yugoslavia and sentenced to five years' imprisonment by a court in Munich. He was acquitted of having been an accessory to genocide as the Court did not establish with sufficient certainty the existence of the intent to destroy, in whole or in part, the group in question (also known as the subjective element of genocide).
